Your Data Rights & Subject Access Requests
UK GDPR gives you rights over the personal data we hold about you. You can exercise any of them free of charge.
You do not need to use a particular form of words, and you do not need to mention the legislation.
Your rights
What you can ask us to do
-
Right of access
Get a copy of your personal data and information about how we use it. Often called a subject access request, or SAR.
-
Rectification
Have inaccurate data corrected, and incomplete data completed.
-
Erasure
Ask us to delete data where there is no good reason for us to keep it. Sometimes called the right to be forgotten.
-
Restriction
Ask us to limit how we use your data while a concern — for example about accuracy — is resolved.
-
Portability
Receive data you gave us in a structured, commonly used, machine-readable format, or have it sent to another controller.
-
Objection
Object to processing based on legitimate interests. You can object to direct marketing at any time and we must stop.
Policy detail
How to make a request
Contact us by email or post, and tell us what you want. It helps if you include:
- Your name, and any other names we may hold you under
- Enough information to identify you in our records — for example the email address or phone number you registered with
- Which right you are exercising, or simply what you want us to do
- What the request covers, if you only want part of your data — for example assignments in a particular period
Email info@komestaffing.co.uk, or write to us at 408 Tower Bridge Business Centre, East Smithfield, London, E1W 1AW, United Kingdom.
Proving who you are
We may ask for identification before releasing personal data. This protects you — we are not able to disclose your data to someone else. We only ask for what is proportionate, and we do not delay the request while waiting for information we do not really need.
How long it takes
We respond within one calendar month of receiving your request and any identification we reasonably need.
If your request is complex, or you have made several requests, we may extend this by up to two further months. We will tell you within the first month if that happens, and explain why.
Fees
Requests are free. We may charge a reasonable administrative fee, or refuse, only where a request is manifestly unfounded or excessive — for example if it is repetitive. If we do, we will explain why and tell you how to challenge it.
When rights are limited
Some rights are qualified rather than absolute. We may not be able to fully comply where:
- We must keep records to meet a legal obligation, such as tax, Right to Work or safeguarding duties
- The data is needed to establish, exercise or defend a legal claim
- Disclosure would reveal personal data about another person who has not consented
- An exemption in the Data Protection Act 2018 applies — for example in relation to certain confidential references or crime prevention
Where we cannot fully comply, we will tell you which exemption or ground applies and what you can do next.
References
Confidential references we give or receive for employment purposes are subject to a specific exemption under the Data Protection Act 2018. We will explain if this affects your request.
If you are unhappy with our response
Tell us — we would rather put it right ourselves. Contact info@komestaffing.co.uk.
You can also complain to the Information Commissioner's Office at any time: ico.org.uk, 0303 123 1113, or Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF. Complaining to the ICO does not affect any other legal remedy available to you.
Make a data request
Send us your request and we will confirm receipt and tell you what happens next.
